Gachagua impeachment case resumes in court

Former Deputy President Rigathi Gachagua has returned to court as the long-running legal challenge against his 2024 impeachment enters a crucial hearing phase, with judges now considering key constitutional questions but no final verdict expected yet.

Gachagua, who was removed from office by Parliament and the Senate in October 2024, is contesting the legality of that process, maintaining that his ouster was unconstitutional and politically driven.

Proceedings resumed at the Milimani Law Courts in Nairobi on Monday this week, where a bench of judges began hearing consolidated petitions challenging both the procedure and substance of the impeachment.

In a notable shift, Gachagua has revised his demands before the court. Instead of seeking reinstatement to the office of Deputy President, he is now pursuing compensation, including salary and benefits he says he lost following his removal.

His legal team argues that the impeachment process was rushed and denied him a fair opportunity to defend himself, describing it as having been conducted at “lightning speed.”

The hearings, which had been scheduled over multiple sessions are expected to continue as both sides present arguments and responses before the court retires to consider its judgment.
